01 THE FOUNDATION

What Is Employee Gratuity Eligibility Checker?

Employee Gratuity Eligibility Checker is an online screening tool for workers who want to understand whether they may qualify for gratuity when employment ends. It considers service duration, employment arrangement, establishment coverage and the circumstances of separation.

Gratuity is a statutory employment benefit associated with qualifying service. It is different from monthly salary, provident fund, pension contributions and ordinary performance bonuses. The right to payment depends on the legal framework applicable to the employee and establishment.

India has historically regulated gratuity through the Payment of Gratuity Act, 1972. The Code on Social Security, 2020 provides the newer legislative framework. For an actual claim, the applicable commencement provisions, notifications and transitional rules must be checked for the relevant employment period and date of separation.

An Employee Gratuity Eligibility Checker is particularly useful before resignation, retirement, settlement discussions or a dispute about service records. It helps identify questions to raise with HR without treating an automated result as a final legal decision.

Who Should Use This Checker?

  • Employees planning to resign after several years of service.
  • Retiring workers reviewing terminal employment benefits.
  • Fixed-term employees checking the provisions applicable to their contracts.
  • Family members reviewing gratuity after an employee's death.
  • HR and payroll teams preparing preliminary settlement reviews.

Eligibility should always be distinguished from the amount payable. A person may satisfy the relevant service requirement but still need to establish wage details, continuity, coverage and the correct payment calculation.

02 SERVICE RULES

Five-Year Service Rule For Gratuity Eligibility

The familiar ordinary gratuity requirement is at least five years of continuous service with the relevant employer, subject to the applicable law and exceptions. The requirement commonly arises when an employee resigns, retires or otherwise leaves employment.

Continuous service is a legal concept rather than simply the number of days between joining and leaving. Certain interruptions, including qualifying leave, sickness, accidents or other circumstances recognised by law, may not destroy continuity.

The Employee Gratuity Eligibility Checker uses completed years, months and additional days to identify the ordinary benchmark. It does not assume that every calendar period qualifies as continuous service or that every break disqualifies an employee.

What About Four Years And 240 Days?

Employees frequently ask whether four years plus 240 days is sufficient. This question arises from continuous-service provisions and judicial interpretations. The outcome is not uniform across every employment situation or jurisdiction.

Certain decisions have interpreted the continuous-service framework in ways that support eligibility before the fifth anniversary. Other legal questions can arise from the applicable provision, establishment type, working pattern and jurisdiction.

Important: The Employee Gratuity Eligibility Checker flags service between four and five years for legal review. It does not automatically declare four years and 240 days eligible.

A five-day working week may also affect the relevant statutory working-day test in particular circumstances. Do not apply a single 240-day shortcut without checking the law and evidence relevant to your case.

Does Leave Count As Continuous Service?

Some authorised or legally recognised interruptions can count toward continuous service. Approved leave, sickness and other protected circumstances may be relevant, depending on the statutory conditions.

Unexplained employment gaps, transfers between separate legal employers and contested absences require additional investigation. Retain attendance records, appointment letters, transfer documents and salary statements before relying on the service total.

The most reliable approach is to verify your date of joining, date of separation, employer identity and any legally qualifying interruptions together rather than looking at service years alone.

03 EXCEPTIONS

Important Exceptions To Gratuity Eligibility

The ordinary five-year rule is not the only route to gratuity. Specific circumstances can alter the service requirement, while other employment arrangements require their own statutory analysis.

Death Or Qualifying Disablement

Under the established gratuity framework, the usual five-year minimum does not apply where employment ends because of death or qualifying disablement. Payment may become due to the appropriate nominee, heir or other legally entitled recipient.

This exception does not remove the need to verify employment coverage, qualifying circumstances and payment records. The Employee Gratuity Eligibility Checker highlights these cases as potentially qualifying without imposing the ordinary five-year benchmark.

Fixed-Term Employment

Fixed-term employment requires special attention under the applicable social-security framework. The newer provisions recognise gratuity treatment for qualifying fixed-term employees, including a shorter service framework in specified circumstances.

A direct fixed-term appointment is not necessarily the same as employment through a contractor or staffing agency. The legal employer, contract terms, commencement dates and applicable statutory provisions all matter.

For this reason, the checker marks fixed-term cases for additional review. A one-year service period can be significant, but the result should not be treated as universal approval for every worker described as contractual.

Termination And Possible Forfeiture

Termination does not automatically eliminate gratuity entitlement. Statutory forfeiture is subject to specific conditions and limitations, and an employer cannot necessarily withhold the entire benefit merely because a disciplinary disagreement exists.

Where misconduct, loss or another forfeiture ground is alleged, the legal basis and extent of any proposed forfeiture should be examined separately. An Employee Gratuity Eligibility Checker cannot adjudicate misconduct or determine the validity of an employer's decision.

Apprentices And Other Workers

A statutory apprentice may be treated differently from an employee for gratuity purposes. However, a job title alone does not establish legal classification. Misclassification and employment-status disputes require examination of actual work and contractual arrangements.

Similarly, outsourced and contractor-supplied workers should identify the relevant employer and applicable obligations. Their eligibility cannot be determined reliably from service duration alone.

04 THE PROCESS

How To Use Employee Gratuity Eligibility Checker

The Employee Gratuity Eligibility Checker follows a straightforward screening process. Enter accurate employment information and review both the status and explanatory notes before deciding whether further documentation is required.

  1. Identify your employment arrangement. Choose regular, fixed-term, contractor-supplied, apprentice or another arrangement according to your documents.
  2. Confirm establishment coverage. Select covered only when you have a reasonable basis for that conclusion. Otherwise, choose the uncertain option.
  3. Enter your completed service. Record completed years, additional months and days without rounding up.
  4. Select the separation reason. Resignation, retirement, termination, death, disablement and continuing employment have different implications.
  5. Review continuity and disputes. Indicate whether service records are confirmed and whether a forfeiture question exists.

After submitting, the checker displays a preliminary status, service benchmark progress and a summary of outstanding conditions. Where the inputs do not support a reliable conclusion, it deliberately recommends verification instead of providing false certainty.

How To Interpret Your Result

Appears to meet the ordinary threshold means the recorded service reaches five years and the selected circumstances do not reveal an obvious unresolved exception. It does not guarantee payment or establish every legal condition.

Special exception may apply means a different statutory route could be relevant, such as death, qualifying disablement or certain fixed-term arrangements. Further review needed means coverage, service continuity or another legal issue remains uncertain.

Below the ordinary threshold means the entered service does not meet the standard five-year benchmark and no identified exception resolves the issue. This does not eliminate a possible claim based on an applicable judicial interpretation or another legal entitlement.

Use the Employee Gratuity Eligibility Checker as a starting point for document review. For important financial or employment decisions, obtain confirmation from your employer or an appropriately qualified adviser.

05 PAYMENT VALUE

Gratuity Eligibility Versus Gratuity Amount

An employee may be eligible for gratuity without knowing the exact payment amount. Eligibility establishes whether a qualifying benefit may arise. The monetary calculation then considers applicable wages, service rules, statutory ceilings and any special provisions.

Under the familiar formula for employees covered by the standard gratuity calculation framework, the amount is generally based on fifteen days of qualifying wages for each counted year of service, using a twenty-six-day monthly divisor.

Illustrative formula:
Gratuity = (Last drawn qualifying monthly wages × 15 × counted years of service) ÷ 26.

The wage base and the treatment of service fractions must follow the applicable legal rules. The familiar calculation may round a qualifying fraction of a year exceeding six months to an additional counted year, but that payment rule must not be confused with the initial eligibility requirement.

Consider an employee with qualifying monthly wages of ₹40,000 and six counted years of service. The illustrative calculation is ₹40,000 × 15 × 6 ÷ 26, giving approximately ₹1,38,462 before any applicable legal adjustments.

This example assumes that the worker qualifies, that the standard formula applies and that ₹40,000 is the correct statutory wage base. It is not an assurance of the amount any particular employer must pay.

Once you have reviewed eligibility with the Employee Gratuity Eligibility Checker, use the site's Gratuity Calculator India to examine the monetary side. For tax treatment, the Gratuity Tax Exemption Calculator India addresses a separate question.

Does Gratuity Form Part Of CTC?

Some employers include an estimated gratuity provision within the annual cost-to-company package. This accounting or compensation presentation does not necessarily mean gratuity is paid to the employee every month.

An amount shown in CTC also does not independently prove eligibility. The employee's statutory rights depend on the applicable rules rather than the presentation of the salary package.

Tax exemption is another distinct issue. A gratuity payment may receive tax relief subject to the recipient's category, statutory limits and other conditions. Do not assume that every gratuity receipt is automatically exempt in full.

06 CLAIMS & RECORDS

Documents And Mistakes To Check Before Claiming

The Employee Gratuity Eligibility Checker is most useful when paired with reliable employment records. Incomplete joining dates, disputed transfers or inconsistent payroll records can materially change the assessment.

Documents Worth Keeping

  • Appointment letter and subsequent employment contracts.
  • Joining confirmation and employment history.
  • Recent payslips and qualifying wage information.
  • Resignation acceptance, retirement or termination documents.
  • Service certificates and relevant transfer records.
  • Nomination and supporting documents where applicable.

In death or disablement cases, additional evidence may be required to establish the qualifying event and identify the person entitled to receive payment. Employees should also retain correspondence about the employer's gratuity determination.

Common Eligibility Mistakes

One frequent mistake is assuming that gratuity becomes payable merely because an employer shows it in a CTC breakup. Another is treating five years as an absolute rule with no statutory exceptions.

Employees also sometimes confuse service rounding used in a payment formula with the service requirement for eligibility. A period of four years and seven months should not automatically be converted into five years for every legal purpose.

A further mistake is ignoring establishment coverage. Statutory applicability depends on the relevant provisions and facts. Employers and workers should verify coverage instead of relying exclusively on present headcount or an informal HR statement.

If a claim is disputed, request the employer's calculation and reasons in writing. Follow the applicable statutory claim and dispute procedure, including the relevant authority and time limits, rather than assuming an online calculator result is sufficient evidence.

Gratuity may form part of a broader employment exit settlement. The Full and Final Settlement Calculator India and Leave Encashment Calculator India help separate other settlement components from gratuity.

SERVICE REFERENCE / 07

Gratuity Eligibility Examples By Service Length

These examples show why service duration alone does not always produce a final answer. Use the Employee Gratuity Eligibility Checker to explore a similar scenario, then verify coverage and applicable law.

A regular employee leaving after six years of qualifying continuous service generally satisfies the ordinary duration benchmark. An employee leaving after two years ordinarily does not, unless an applicable exception changes the position.

A four-year-and-eight-month case requires particular care because judicial interpretation and continuous-service rules may matter. Death, qualifying disablement and fixed-term employment can involve different service requirements.

Official starting points include the Ministry of Labour and Employment and the India Code legislative database.

Illustrative gratuity eligibility scenarios
Situation Preliminary interpretation
Regular employee, 2 years, resignation Below ordinary five-year benchmark
Regular employee, 4 years 8 months Legal and continuity review required
Regular employee, 5 completed years Ordinary service threshold appears met
Regular employee, 10 years Ordinary service threshold appears met
Employment ends due to death Five-year exception may apply
Qualifying fixed-term employment Special statutory provisions require review
All examples assume the relevant legal framework is applicable. They do not establish an individual employee's entitlement.

QUICK ANSWERS / 10

Employee Gratuity Eligibility Checker FAQs

Answers to common questions about qualifying service, resignation, exceptions and gratuity claims.

01 What is Employee Gratuity Eligibility Checker?+

Employee Gratuity Eligibility Checker is a preliminary screening tool that compares your service period and employment circumstances with common Indian gratuity requirements. It highlights ordinary eligibility benchmarks, exceptions and unresolved issues.

02 Is gratuity payable after five years?+

Five years of qualifying continuous service generally satisfies the ordinary duration requirement where the applicable gratuity framework covers the employee. Other legal conditions and any valid forfeiture issues still need consideration.

03 Can I receive gratuity after four years and 240 days?+

It may be possible in circumstances supported by the applicable continuous-service provisions and judicial interpretation. However, four years and 240 days is not a universal automatic entitlement. Obtain advice relevant to your jurisdiction and records.

04 Is gratuity available after resignation?+

Resignation can trigger gratuity entitlement where the applicable qualifying conditions are met. Resignation by itself does not necessarily remove an employee's statutory right to gratuity.

05 Does death remove the five-year requirement?+

Under the established gratuity framework, the ordinary five-year minimum does not apply when employment ends because of death. Coverage, recipient entitlement and the applicable legal provisions still require verification.

06 Are fixed-term employees eligible for gratuity?+

Qualifying fixed-term employees may receive special treatment under the applicable social-security provisions. Direct fixed-term employment should not be confused automatically with contractor-supplied work. Check the contract and statutory commencement provisions.

07 Is gratuity included in monthly salary?+

Gratuity is generally a terminal employment benefit rather than an ordinary monthly salary payment. An employer may show a gratuity provision in CTC, but this does not mean the provision is paid to the employee each month.

08 Can an employer refuse gratuity after termination?+

Termination alone does not automatically justify withholding gratuity. Statutory forfeiture depends on defined grounds and conditions. The validity and extent of any forfeiture should be assessed individually.

09 Does a break in service always disqualify me?+

No. Some interruptions may be treated as continuous service under the applicable law. The nature of the interruption, supporting records and statutory provisions determine whether it affects eligibility.

10 Can I use the checker while still employed?+

Yes. Employee Gratuity Eligibility Checker can help you understand your current service position. However, satisfying a service benchmark while still employed does not mean gratuity must immediately be paid.

11 Does the checker calculate the gratuity amount?+

No. This tool focuses on preliminary eligibility. The gratuity amount depends on qualifying wages, counted service and applicable rules. Use the separate gratuity calculator for an illustrative payment calculation.

12 Where can I verify official gratuity rules?+

Consult the Ministry of Labour and Employment, applicable government notifications and the India Code database. For disputed claims, seek guidance from the appropriate labour authority or qualified legal professional.
