Gratuity Tax Exemption Calculator India Formula
The exemption formula depends on the category of employee and the circumstances in which gratuity is received.
| Employee category | Exemption method |
|---|---|
| Qualifying government employee | Generally the entire qualifying death-cum-retirement gratuity is exempt. |
| Non-government employee covered by the Gratuity Act | Least of actual gratuity, applicable ceiling and 15/26 × last drawn eligible monthly salary × qualifying service years. |
| Non-government employee not covered by the Gratuity Act | Least of actual gratuity, applicable ceiling and 1/2 × average eligible monthly salary × completed service years. |
| Gratuity received during continuing employment | Generally fully taxable as salary income. |
For a non-government employee, the exemption normally cannot exceed the actual gratuity received. Even when the salary-based calculation is higher, the statutory ceiling can restrict the exempt amount. Any balance remaining after the allowable exemption may be included in taxable salary income.
Gratuity Tax Exemption For Employees Covered By The Gratuity Act
For a qualifying non-government employee covered by the Payment of Gratuity Act framework, the exemption is generally determined by comparing three amounts: the gratuity received, the statutory monetary ceiling and the amount calculated using the eligible last drawn salary and service period.
The commonly applied formula is 15 × last drawn monthly eligible salary × qualifying service years ÷ 26. Eligible salary generally includes basic salary and dearness allowance. Bonus, house rent allowance, overtime and ordinary allowances are not added to this salary base.
How service years are counted
For this calculation, completed years of service and a remaining period exceeding six months are generally counted as an additional year. Thus, 12 years and seven months is treated as 13 years. Twelve years and exactly six months is not automatically rounded to 13 years under the strict more-than-six-month rule.
Do not confuse the service rounding rule with the conditions for gratuity eligibility. Eligibility can depend on continuous service, the nature of termination and applicable statutory exceptions. A tax exemption calculation does not independently establish whether the employer must pay gratuity.
The Gratuity Tax Exemption Calculator India applies this rounding method to Act-covered employees. The result is useful for estimating the exemption but should be compared with the employer's actual computation and the rules in force when the payment becomes due.
Tax Exemption When The Gratuity Act Does Not Apply
Some non-government employees receive gratuity under employment terms or another applicable arrangement without being covered by the Gratuity Act. Their exemption calculation is different from the 15/26 method used for Act-covered employees.
The usual exemption formula is one-half of the average eligible monthly salary multiplied by completed years of service. The salary average is generally based on the ten months immediately preceding the relevant retirement or termination event.
For this category, eligible salary can include basic salary, qualifying dearness allowance and qualifying turnover-based commission. Ordinary bonuses, unrelated allowances and reimbursements should not be added merely because they appear on a payslip.
Unlike the Act-covered formula, an incomplete year is generally ignored when counting completed years under this exemption method. Therefore, an employee with 12 years and eight months ordinarily uses 12 completed years for the non-Act formula.
The Gratuity Tax Exemption Calculator India provides a separate ten-month average salary input for this category. Enter the actual eligible average rather than assuming the latest month's salary accurately represents the entire period.
Government Employee Gratuity Tax Exemption
Qualifying death-cum-retirement gratuity received by eligible government employees is generally fully exempt under the relevant income-tax provisions. This treatment differs from the capped exemption normally applied to non-government employees.
Government employee classification matters. Employment in a government-owned company, statutory corporation, public-sector undertaking or government-funded organisation does not automatically establish eligibility for the same exemption as a qualifying government servant.
The Gratuity Tax Exemption Calculator India offers a government employee category for qualifying payments. When selected, it treats the entered eligible gratuity as exempt, subject to the assumption that the recipient and payment satisfy the relevant statutory requirements.
Government gratuity payment ceilings are a separate question from income-tax exemption. For example, the Central Government enhanced certain retirement and death gratuity payment ceilings to ₹25 lakh effective January 2024 under specified pension rules. That does not mean the non-government Section 10(10) exemption ceiling universally became ₹25 lakh.
Gratuity Tax Exemption Calculator India Examples
Example 1: Employee covered by the Gratuity Act
Assume an employee receives ₹10,00,000 in gratuity after 12 years and seven months of service. The last drawn eligible monthly salary is ₹80,000. There are no previous gratuity exemptions affecting the ceiling.
The qualifying service period becomes 13 years. The salary-based exemption equals ₹80,000 × 15 × 13 ÷ 26, or ₹6,00,000. The least of ₹10,00,000 received, ₹20,00,000 ceiling and ₹6,00,000 formula amount is ₹6,00,000.
Therefore, the estimated exempt gratuity is ₹6,00,000 and the estimated taxable gratuity is ₹4,00,000. This is the default worked scenario in the calculator.
Example 2: Employee not covered by the Gratuity Act
Assume the employee receives ₹8,00,000, has 10 completed years of service and an eligible average monthly salary of ₹60,000. The salary-based exemption equals ₹60,000 × 1/2 × 10, or ₹3,00,000.
The exemption is the least of ₹8,00,000, ₹20,00,000 and ₹3,00,000. Accordingly, ₹3,00,000 is exempt and ₹5,00,000 remains taxable under these assumptions.
Example 3: Gratuity exceeding the ceiling
Suppose an Act-covered employee receives ₹25,00,000 and the applicable salary-based exemption formula produces ₹27,00,000. With no previous exemption claims, the ₹20,00,000 ceiling is the smallest applicable limit.
The estimated exempt amount is ₹20,00,000 and the taxable balance is ₹5,00,000. This illustrates why a large gratuity payment is not necessarily fully tax-free, even after a long period of employment.
Gratuity Tax Exemption Rules, Limitations And Common Mistakes
The exemption is not always calculated independently for each employer. Earlier exempt gratuity receipts may reduce the remaining monetary ceiling available for subsequent non-government gratuity payments. Multiple receipts in the same year can also require aggregation.
For a reliable estimate, collect the settlement letter, salary breakup, dates of employment, qualifying service records and details of any earlier gratuity exemptions. Keep the exemption calculation separate from the question of whether the employee is entitled to receive the stated gratuity.
Important checks before filing
- Confirm whether the employer and employment are covered by the applicable gratuity legislation.
- Use eligible salary components rather than total gross salary or annual CTC.
- Apply the correct service rounding rule for the employee category.
- Account for previous gratuity exemptions and multiple employers.
- Distinguish a gratuity payment made on termination from one paid during continuing employment.
- Verify whether the gratuity receipt relates to retirement, resignation, death, disablement or another qualifying event.
The Gratuity Tax Exemption Calculator India does not compute tax slab liability on the taxable portion. It identifies the amount potentially includible in taxable income. Your actual tax depends on other income, applicable rates, reliefs and the relevant tax year.
Special employment situations, seasonal establishments, death or disablement, historical gratuity receipts and changes in legislation may require a different approach. The calculator uses ordinary employee assumptions and should not replace a review of the applicable law.
Understand The Three Exemption Limits.
For most qualifying non-government gratuity receipts, the exempt amount is restricted to the lowest applicable amount. This comparison prevents the exemption from exceeding the actual receipt, salary-based calculation or remaining monetary ceiling.
The commonly referenced ₹20 lakh ceiling is an aggregate limit subject to applicable provisions and previous exempt gratuity claims. It is not an automatic tax-free allowance for every employee.
Read the official Income Tax Department Section 10(10) provision and the Income from Salary guidance before finalising a claim.
| Limit | What it means |
|---|---|
| Actual receipt | The gratuity amount received by the employee. |
| Formula amount | The salary and service-based amount under the applicable category. |
| Monetary ceiling | Generally ₹20 lakh, reduced where relevant by earlier exempt gratuity. |
| Taxable balance | Actual receipt minus the eligible exemption. |

Gratuity Tax Exemption Calculator India FAQs
Answers to common questions about gratuity exemption, salary definitions, service periods and tax treatment.
01 Is gratuity completely tax-free in India? +
Not for every employee. Qualifying government gratuity is generally fully exempt, while non-government gratuity is normally subject to the actual receipt, applicable salary-based formula and statutory ceiling. The Gratuity Tax Exemption Calculator India compares these limits.
02 What is the ₹20 lakh gratuity exemption limit? +
It is the generally applicable monetary ceiling for qualifying non-government gratuity exemptions under the commonly published Section 10(10) framework. The amount actually exempt may be lower, and previous exemptions can reduce the remaining available ceiling.
03 Is gratuity exempt under the new tax regime? +
Qualifying gratuity exemption is generally available under both the old and new tax regimes. The amount depends on the statutory exemption provisions rather than the selection of ordinary salary deductions such as Section 80C.
04 Does the calculator determine gratuity eligibility? +
No. It estimates the tax exemption on an entered gratuity receipt. Eligibility to receive gratuity is a separate employment-law question involving service, coverage and the circumstances of termination.
05 Does basic salary include HRA for gratuity exemption? +
No. For the ordinary Act-covered formula, eligible salary generally includes basic pay and dearness allowance, not HRA. The non-Act category has its own eligible salary definition, including certain qualifying commission.
06 Is gratuity taxable when I resign? +
A qualifying gratuity payment received on resignation or termination can receive the applicable exemption. Any amount exceeding the allowable exemption may be taxable. The result depends on the employment category and circumstances.
07 What happens if I worked for 12 years and seven months? +
For the ordinary Act-covered formula, a remaining service period exceeding six months generally counts as an additional year, producing 13 years. For the non-Act exemption formula, completed years are used, so the result is generally 12 years.
08 Can I claim gratuity exemption from two employers? +
Potentially, yes, but the aggregate exemption ceiling and earlier exempt receipts must be considered. The monetary limit is not necessarily reset independently for every employer. Verify previous claims before calculating the available balance.
09 Is gratuity received during employment tax-free? +
Gratuity paid during continuing employment is generally fully taxable as salary. The usual terminal gratuity exemption should not automatically be applied to an advance or other in-service payment.
10 Does taxable gratuity mean I must pay that amount as tax? +
No. Taxable gratuity is the portion potentially included in taxable income, not the amount of income tax itself. Your final tax depends on total income, applicable rates, reliefs and other relevant circumstances.
