Retrenchment Compensation Calculator India: Calculate Your Estimate

Enter the average monthly pay relevant to the applicable statutory definition and your completed service. The calculator applies the commonly used 15-days-per-qualifying-year method. It estimates an amount, not legal entitlement.

01 — EMPLOYMENT DETAILS STATUTORY METHOD
Use average pay under the law applicable to your employment. Do not automatically substitute total CTC or take-home salary.
For precise service, use the actual joining and separation dates with HR records. Days entered here are approximate and cannot replace calendar-based continuous-service assessment.
Additional calculation assumptions +
The correct wage conversion depends on the governing provision and payment basis. A 30-day divisor is not automatically the statutory method.
This is displayed separately. It is not included in the statutory retrenchment result.
Notice obligations depend on the applicable law, establishment, permissions, and circumstances. These options do not determine your legal notice entitlement.

This calculator does not establish whether you qualify as a worker, whether retrenchment law applies, or whether the termination is legally valid. Verify all relevant conditions before relying on the estimate.

CALCULATION METHOD / 03

Retrenchment Compensation Calculator India Formula

The standard illustrative approach multiplies average daily pay by 15 days and the number of qualifying years of continuous service. The applicable statutory wage definition and service rules must be checked first.

Retrenchment compensation calculation stages
Stage Calculation
Average monthly pay Use the amount determined under the applicable legal definition of average pay.
Average daily pay For a monthly-rated worker, monthly average pay ÷ 26 under the illustrated method.
Qualifying service Completed years plus an additional year for a qualifying remainder exceeding six months.
Compensation Daily average pay × 15 × qualifying years.
Separate dues Assess notice pay, gratuity, earned salary, leave and other payments independently.
The 26-day divisor and 15-day multiplier represent the commonly applied statutory calculation. Verify the governing law and any more favourable contractual or statutory provision.

For example, a worker with ₹30,000 average monthly pay and five qualifying years has an illustrative daily rate of ₹1,153.85. Multiplying that rate by 15 and then by five gives approximately ₹86,538. This is not necessarily the complete amount payable when employment ends.

02 LEGAL FRAMEWORK

What Is Retrenchment Compensation In India?

Retrenchment compensation is a statutory payment that may become payable when an eligible worker's employment is terminated in circumstances covered by retrenchment law. It is distinct from ordinary monthly salary, severance offered voluntarily by an employer, and benefits payable under other employment statutes.

The Retrenchment Compensation Calculator India estimates the wage-and-service component of this payment. It does not decide whether a termination legally qualifies as retrenchment. That question depends on the governing legislation, exclusions, the worker's role, the establishment, and the reason for termination.

Historically, Section 25F of the Industrial Disputes Act, 1947 prescribed conditions for retrenchment of qualifying workmen, including notice-related requirements and compensation based on 15 days' average pay for every completed year of continuous service or qualifying part exceeding six months.

India's labour-code framework, including the Industrial Relations Code, 2020, changes how relevant statutory provisions must be identified. The operative rules and transitional position should be verified for the retrenchment date and jurisdiction. Do not assume an older section reference remains the only applicable authority.

Who may qualify for compensation?

Eligibility is not determined by job title alone. The legal classification of a worker, the nature of duties, the establishment's coverage, continuous service and statutory exceptions can all matter. A person working in a managerial or administrative capacity may face a different legal position from an eligible worker performing covered duties.

Some terminations may fall outside the legal definition of retrenchment. Examples requiring separate analysis include voluntary retirement, certain disciplinary dismissals, retirement on superannuation, specified contract expirations and termination for continued ill health. The precise exceptions depend on the law in force.

Why continuous service matters

Qualifying continuous service can include periods that count under statutory deeming provisions. It should not always be measured simply by subtracting a joining date from an exit date. Certain interruptions, leave periods and prescribed days-worked tests may affect the determination.

In particular, a service remainder of more than six months is treated differently from a remainder of exactly six months under the traditional rounding rule. The calculator uses that distinction but cannot independently establish whether an employee has completed the legally required continuous service.

Official reference points include the Ministry of Labour and Employment and India Code. Check the applicable legislation and current government notifications rather than relying on a formula alone.

03 WORKED EXAMPLES

5 Practical Retrenchment Compensation Examples

These examples use a monthly-rated worker, a 26-day wage divisor and 15 days of compensation per qualifying year. They assume the statutory calculation applies. Each amount is illustrative, rounded to the nearest rupee and excludes other final-settlement items.

Example 1: Five completed years

Assume average monthly pay is ₹30,000 and qualifying service is five years. The daily rate is ₹30,000 ÷ 26, or approximately ₹1,153.85. Compensation is that daily rate multiplied by 75 days, producing approximately ₹86,538.

Example 2: Seven years and eight months

With ₹40,000 average monthly pay and seven years plus eight months of qualifying service, the remainder exceeds six months. Under the illustrated rounding method, eight years are counted. The estimate is ₹40,000 ÷ 26 × 15 × 8, approximately ₹1,84,615.

Example 3: Three years and exactly six months

For average monthly pay of ₹25,000 and three years plus exactly six months of service, the remainder does not exceed six months. The illustrative method counts three qualifying years. Compensation is approximately ₹43,269, subject to legal continuous-service rules.

Example 4: Ten completed years

Suppose average monthly pay is ₹60,000 and qualifying service is ten years. The daily wage estimate is ₹2,307.69. Multiplying by 150 compensation days gives approximately ₹3,46,154. Any separate gratuity or notice payment requires its own assessment.

Example 5: A higher contractual benefit

Assume ₹50,000 average monthly pay, six qualifying years and an employment arrangement providing 30 days per year instead of 15. A 30-day comparison gives approximately ₹3,46,154. That does not prove the higher amount is legally due; the relevant contract, policy, settlement or award must establish entitlement.

Use the Retrenchment Compensation Calculator India to test these scenarios by changing wages, years and the multiplier. The 30-day option is a comparison tool, not a statement that every employer must provide 30 days.

04 FINAL SETTLEMENT

Retrenchment Compensation Versus Full And Final Settlement

Retrenchment compensation is one possible component of an employee's exit settlement. A complete settlement can also involve unpaid wages, eligible leave encashment, gratuity, contractual payments, approved reimbursements and adjustments for recoveries. These amounts arise under different rules and should not be combined without checking eligibility.

The Retrenchment Compensation Calculator India keeps notice pay separate to prevent an illustrative combined figure from being mistaken for statutory retrenchment compensation. Notice may be served, paid in lieu, or subject to different statutory requirements depending on the establishment and governing law.

Notice pay and statutory permissions

Some retrenchment situations involve prior notice, notice wages, government notification or permission requirements. Additional provisions can apply to particular industrial establishments or workforce thresholds. An employer should verify those obligations before assuming that payment of compensation alone makes a retrenchment compliant.

Similarly, a three-month notice-pay scenario in the calculator does not establish that a three-month notice period applies to every employee. Use the applicable statutory provision and employment records to determine the actual obligation.

Gratuity and leave encashment

Gratuity is a separate employment benefit with its own qualifying conditions, wage definition and formula. It should not be automatically treated as part of retrenchment compensation. Review the gratuity calculator and gratuity eligibility checker when assessing an exit package.

Unused leave may also create a payment depending on statutory requirements and the employer's policy. The leave encashment calculator can help estimate that component. Do not assume every unused leave category is encashable on identical terms.

Provident fund and other benefits

Provident fund balances and employer contributions are governed by separate retirement-benefit rules. The treatment of a provident fund account after separation is not the same as payment of retrenchment compensation. For account-specific questions, consult the Employees' Provident Fund Organisation.

For an overall exit estimate, use the full and final settlement calculator. It is important to reconcile the components individually rather than treating one combined amount as proof that every legal obligation has been satisfied.

05 DOCUMENT CHECKS

How To Check A Retrenchment Compensation Calculation

Before accepting a compensation figure, compare the employer's calculation with the wage records, continuous-service details and statutory provision used. A small difference in qualifying years or wage definition can materially change the amount.

  1. Identify the applicable law. Confirm the legal framework in force on the retrenchment date and whether your role and establishment fall within it.
  2. Verify average pay. Check the relevant pay period and statutory wage components rather than using CTC without adjustment.
  3. Confirm continuous service. Review the joining date, termination date, attendance records, qualifying interruptions and any deemed-service provisions.
  4. Apply the correct multiplier. Verify the statutory compensation days and whether a more favourable enforceable provision applies.
  5. Reconcile other dues. Check notice wages, gratuity, leave encashment, earned salary and documented deductions separately.

Documents worth keeping

Retain your appointment letter, salary slips, wage statements, attendance and leave records, relevant employer policies, termination or retrenchment notice, and the final settlement statement. These documents help establish the calculation basis and make it easier to identify a genuine discrepancy.

Common mistakes to avoid

A frequent mistake is entering annual CTC divided by twelve as statutory average monthly pay. CTC may contain employer-funded benefits that do not belong in the applicable wage base. Another mistake is counting every partial service year as a full year, even when the statutory remainder threshold is not met.

Employees may also confuse retrenchment compensation with gratuity, ex gratia payments or severance offered under a company policy. These amounts may coexist but should be identified separately. A higher contractual payment does not automatically change the statutory formula used to calculate the minimum entitlement.

The Retrenchment Compensation Calculator India is most useful as a transparent arithmetic check after the legally relevant inputs have been determined. Where classification, continuous service, termination grounds or statutory permissions are disputed, obtain advice from a qualified labour-law professional or the competent labour authority.

06 INTERPRETATION

Understanding Your Compensation Result

A calculator result should be interpreted as a wage-based estimate, not as a guaranteed payment. The actual entitlement can be higher or lower depending on the law, qualifying service, average-pay definition, enforceable agreements and whether retrenchment provisions apply at all.

Compensation calculations also do not determine whether a retrenchment was procedurally lawful. Notice, government permissions, selection rules, re-employment obligations and other conditions may need independent review. The calculation is only one part of that wider employment-law assessment.

Income-tax treatment is another separate issue. The Income-tax Act contains provisions dealing with eligible retrenchment compensation, including Section 10(10B), but exemption conditions and limits must be verified for the relevant assessment year. Do not assume the entire amount is automatically tax-free.

For current statutory and tax references, consult the Income Tax Department and official labour legislation. A professional review is particularly useful for large payments, disputes or settlements involving several overlapping employment benefits.

How Service Rounding Changes Compensation

The illustrative method counts a completed year of qualifying service and adds another year when the remaining service exceeds six months. Exactly six months is not the same as more than six months.

The table assumes the worker otherwise meets the applicable legal conditions. Actual continuous-service determinations may require statutory deemed-service rules and cannot always be reduced to calendar duration.

Use the compensation workbench to apply the appropriate average pay to the qualifying service period.

QUICK ANSWERS / 09

Retrenchment Compensation Calculator India FAQs

Answers to common questions about the formula, eligibility, service duration and settlement payments.

01 What is the retrenchment compensation formula in India?+

Under the illustrated 15-day method, compensation equals average daily pay multiplied by 15 and by qualifying years of service. For a monthly-rated worker, the calculator defaults to a 26-day divisor. The applicable law and wage definition must be verified.

02 Is retrenchment compensation mandatory for every employee?+

No. Statutory entitlement depends on coverage, worker classification, qualifying continuous service, the nature of termination and the law in force. A company may also have separate contractual severance arrangements.

03 How are six months of additional service treated?+

Under the traditional statutory calculation, a remainder exceeding six months can count as another qualifying year. Exactly six months does not meet the more-than-six-month threshold. Continuous-service rules must still be considered.

04 Can I use my total CTC as average pay?+

Not automatically. CTC may include employer benefits and costs that do not form part of statutory average pay. Determine the legally relevant wage amount from payroll records before entering it in the calculator.

05 Is retrenchment compensation different from gratuity?+

Yes. They arise under different legal provisions and qualifying conditions. An eligible employee may have separate entitlements. Use the gratuity calculator to estimate that benefit independently.

06 Does retrenchment compensation include notice pay?+

No. The principal calculation excludes notice pay. The calculator provides an optional separate illustration, but actual notice obligations depend on the governing statutory and contractual provisions.

07 What happens if I worked less than one year?+

The answer depends on statutory continuous-service and deemed-service rules. A short calendar period alone cannot establish eligibility. This calculator may display arithmetic for short service, but that is not confirmation of a legal right to compensation.

08 Is retrenchment compensation tax-free?+

Eligible compensation may qualify for an income-tax exemption under Section 10(10B), subject to applicable limits and conditions. Any excess or non-qualifying payment requires separate tax analysis. Check current Income Tax Department guidance.

09 Can a company offer more than 15 days per year?+

A more favourable enforceable agreement, settlement, award or policy may provide additional benefits. The calculator's 30-day option is intended for comparison, not as a universal statutory entitlement.

10 Does the calculator determine whether my dismissal was legal?+

No. Retrenchment legality may involve notice, permissions, worker selection, statutory exclusions and other procedures. The tool calculates a possible wage-based amount only.

11 Which documents should I check?+

Review appointment documents, salary records, joining and exit dates, attendance records, employer policies, termination notices and settlement statements. These help verify both the wage base and qualifying service.

12 Where can I verify the applicable law?+

Use India Code, the Ministry of Labour and Employment, relevant government notifications and the competent labour authority. Obtain professional advice for disputed entitlements.
