Severance Pay Calculator India Formula

The Severance Pay Calculator India formula separates retrenchment compensation, gratuity, notice pay and other confirmed settlement items instead of treating them as a single universal benefit.

Illustrative calculation components
Component Calculation approach
Retrenchment compensation Applicable daily average pay × 15 × qualifying service years, where the statutory rule applies.
Gratuity Eligible monthly wages ÷ 26 × 15 × eligible service years, subject to applicable conditions and limits.
Notice pay Applicable monthly notice-pay wage base ÷ selected divisor × payable notice days.
Other settlement additions Verified leave encashment, contractual ex gratia and other confirmed amounts.
Combined estimate Selected compensation components + other additions − recoveries.
The same monthly wage input is used for each component in this simplified calculator. Actual statutory definitions of wages and average pay can differ. The combined result is not a statutory entitlement or net bank-credit calculation.
Important calculation distinction

Retrenchment compensation and gratuity are different benefits with separate eligibility rules. A worker may qualify for one, both or neither. Notice pay may also be paid in lieu of notice or satisfied through actual notice served.

Who May Qualify for Severance Pay in India?

Severance Pay Calculator India is most useful when you first identify the reason employment is ending. Indian law does not provide one identical severance payment to every employee who leaves a job. The legal treatment of retrenchment, resignation, retirement, fixed-term contract expiry and misconduct-related termination can differ substantially.

For a qualifying worker covered by the applicable retrenchment provisions, compensation may be calculated using 15 days of average pay for each completed year of continuous service, including a qualifying part-year. However, statutory definitions, exclusions, service conditions and establishment-specific requirements must be checked before using the formula as an entitlement.

The Industrial Relations Code, 2020 is a central reference for retrenchment requirements. It should be read alongside applicable rules, notifications and relevant employment terms. Certain establishments or employment categories can be governed by additional or different provisions.

Employment categories that need separate review

  • Qualifying retrenched workers: may have statutory compensation and notice protections when the relevant conditions are satisfied.
  • Voluntary resignations: generally do not create an automatic right to statutory retrenchment compensation, although other benefits may remain payable.
  • Fixed-term employees: may qualify for gratuity under specific rules even where the normal five-year condition does not apply.
  • Employees leaving on retirement: may receive eligible gratuity, retirement benefits and contractual payments without being retrenched.
  • Employees facing disputed termination: should establish the legal classification of the termination before accepting a payout calculation.

Use the Severance Pay Calculator India result as a planning figure only after reviewing your appointment letter, employment status, last drawn qualifying wages and continuous service record. Where a dispute exists, obtain advice from an appropriate employment-law professional.

The official Code on Social Security, 2020 provides statutory background for gratuity and other social-security benefits.

03 BENEFIT COMPONENTS

What Is Included in a Severance Settlement?

A termination settlement may contain several payments that are often described collectively as severance. The Severance Pay Calculator India tool displays the major components separately so you can understand which amounts are statutory-style estimates and which require contractual confirmation.

1. Retrenchment compensation

Where statutory retrenchment compensation applies, the calculation commonly uses 15 days of average pay for every completed qualifying year, with the relevant treatment of additional service. This payment is different from salary already earned and does not automatically apply to every type of dismissal.

2. Gratuity

Gratuity is a service-linked benefit governed by separate legal provisions. For many regular employees, five years of continuous service is the ordinary qualifying condition, subject to exceptions. Eligible fixed-term employment and death or disablement can involve different eligibility treatment.

The usual monthly-rated gratuity illustration multiplies qualifying wages by 15, divides by 26 and applies the relevant service period. Statutory ceilings, wage definitions and service-rounding rules can affect the actual payment. The gratuity calculator provides a more focused starting point.

3. Notice pay

Notice pay is relevant when an employer pays cash instead of requiring some or all of an applicable notice period. The amount may depend on the governing law, employment agreement, wage definition and days of notice already served. The calculator lets you specify the number of payable days.

4. Leave encashment and other dues

Unused eligible leave, outstanding salary, approved reimbursements, earned incentives and contractual payments may form part of the final settlement. Each item has its own eligibility and valuation rules. Use the leave encashment calculator for additional planning.

5. Recoveries and deductions

A settlement statement may also show advances, loans, permitted notice recoveries or other adjustments. Such entries must have a valid basis. Do not assume every employer-listed deduction is automatically enforceable.

Avoid double counting

If your employer's severance offer already includes gratuity or notice pay, do not add those amounts a second time. Ask for a component-wise statement showing the legal or contractual basis of every payment.

04 STEP-BY-STEP

How to Use Severance Pay Calculator India

The Severance Pay Calculator India workbench is designed to turn a complex employment exit into a transparent calculation. Five practical steps help you prepare the inputs and interpret the result without confusing an estimate with an enforceable claim.

  1. Confirm your exit category. Determine whether the situation is retrenchment, resignation, retirement, fixed-term expiry or another termination. The category affects which benefits may apply.
  2. Identify qualifying wages. Check your payroll records and the applicable statutory definition. CTC, gross salary and qualifying wages are not interchangeable.
  3. Enter your service period. Use completed years and additional months of continuous service. Preserve exact joining and leaving dates for formal verification.
  4. Review gratuity and notice pay. Select the relevant gratuity scenario and enter only the notice days actually payable in cash.
  5. Check the breakdown. Compare each result with your employer's written calculation, then add independently verified dues and recoveries.

Worked example: ₹50,000 monthly wages

Assume an eligible retrenchment scenario with four completed qualifying years, monthly wages of ₹50,000 and an illustrative daily-wage divisor of 26. The compensation calculation is ₹50,000 ÷ 26 × 15 × 4, producing approximately ₹1,15,385.

If the employee also satisfies the relevant gratuity requirements, a separate gratuity calculation may be necessary. A normal four-year service period does not, by itself, establish ordinary five-year gratuity eligibility. This is why the calculator does not automatically award gratuity in every exit scenario.

If 30 days of notice pay are separately due and a 30-day monthly divisor applies, the additional notice-pay illustration is ₹50,000. The combined amount can then be adjusted for verified additions and recoveries. These assumptions should be checked against the governing documents.

Five common calculation mistakes

  • Using annual CTC instead of the legally applicable wage base.
  • Assuming voluntary resignation automatically qualifies for retrenchment compensation.
  • Applying the gratuity service rule to every employee without checking exceptions.
  • Adding notice pay even when the required notice has already been served.
  • Treating the gross settlement estimate as the final post-tax bank deposit.

For a broader exit calculation, use the full and final settlement calculator. It helps organise the amounts that fall outside the main severance formula.

05 EXIT SCENARIOS

Resignation, Layoff and Retrenchment: Key Differences

An employee leaving voluntarily may receive unpaid salary, eligible gratuity, leave encashment and other contractual dues without receiving statutory retrenchment compensation. An employer-initiated reduction in workforce can raise different questions about classification, notice, compensation and procedural requirements.

The everyday word “layoff” does not always have the same meaning as the statutory concepts of lay-off and retrenchment. Temporary inability to provide work, permanent workforce reduction, closure and dismissal for misconduct should not be treated as interchangeable legal events.

A mutual separation agreement may provide an ex gratia amount beyond statutory minimums. Its wording can affect release of claims, confidentiality, benefits, payment timing and dispute resolution. Review the actual agreement before treating the offered amount as final.

The Severance Pay Calculator India workbench intentionally excludes retrenchment compensation for ordinary resignation and retirement scenarios. That design prevents the tool from suggesting that every employment exit creates the same statutory entitlement.

What to check before accepting a settlement

Request the proposed last working date, reason for separation, service record, qualifying wage calculation, statutory compensation details, gratuity assessment and any applicable notice adjustment. Keep copies of appointment letters, salary slips, written communications and final settlement statements.

Also confirm when payments will be made and how any tax withholding will be reported. Gratuity and other termination-related receipts can have different income-tax treatments depending on their legal character and the employee's circumstances.

The notice period recovery calculator can help model one common adjustment. It should not replace a review of contractual terms or statutory restrictions.

06 INTERPRETATION

Understanding the Limits of a Severance Estimate

The Severance Pay Calculator India result is a mathematical illustration, not a legal decision. Actual compensation depends on the relevant statutory provision, wage definition, qualifying service, employer category, applicable government rules and any more favourable contractual arrangement.

The model uses a selectable daily-wage divisor for retrenchment compensation and a 26-day divisor for ordinary monthly-rated gratuity illustrations. These assumptions should not be substituted for the exact method prescribed by the law applicable to your circumstances.

Gratuity is also subject to applicable statutory limits. The calculator does not automatically impose a monetary ceiling because the correct treatment may depend on the applicable rules, notifications and any more favourable terms. A calculated amount above a statutory limit is not necessarily payable in full.

For eligible fixed-term employment, the model uses a proportionate gratuity illustration after the stated one-year threshold. The precise entitlement and treatment of service must be verified from the applicable rules and employment record.

No tax exemption is assumed. Income-tax treatment of retrenchment compensation, gratuity, leave encashment and ex gratia payments can differ. The result should therefore be read as a pre-tax scenario rather than an expected bank deposit.

The Ministry of Labour and Employment's 2026 Labour Codes FAQs provide official clarification on fixed-term gratuity and related provisions.

Understand the 15-Day Compensation Method.

The Severance Pay Calculator India reference table shows how an illustrative 15-day-per-year calculation changes with service length. It assumes ₹50,000 in qualifying monthly wages and a 26-day divisor.

For retrenchment, a qualifying part-year exceeding six months can affect the service count. The tool models that rule for the selected retrenchment scenario. Gratuity uses separate eligibility and rounding treatment.

These examples are not minimum guaranteed payouts. Verify the applicable Industrial Relations Code provisions, rules and employment conditions.

QUICK ANSWERS / 09

Severance Pay Calculator India: Frequently Asked Questions

Practical answers about eligibility, calculation methods, gratuity, notice pay and employment termination in India.

01 What is severance pay in India? +

Severance pay is a broad term for compensation associated with employment termination. Depending on the circumstances, a settlement may include statutory retrenchment compensation, eligible gratuity, notice pay and contractual benefits. These components do not share one universal eligibility rule.

02 How does Severance Pay Calculator India work? +

Severance Pay Calculator India uses your qualifying wages, service period, exit scenario and selected assumptions to estimate individual settlement components. It then combines applicable illustrative amounts and any manually entered additions or recoveries. The result does not independently verify statutory eligibility.

03 Is severance mandatory for every employee? +

No. Statutory retrenchment compensation depends on the worker's legal classification, the reason for termination, qualifying service and applicable provisions. An employment contract or settlement agreement may provide additional benefits even where statutory retrenchment compensation is not applicable.

04 What is the 15-day severance formula? +

An illustrative retrenchment formula is 15 days of applicable average pay multiplied by qualifying service years. The exact daily-pay calculation and treatment of service must follow the relevant legal provisions. The calculator provides an adjustable monthly-wage divisor for scenario planning.

05 Does resignation qualify for severance? +

Voluntary resignation does not ordinarily create automatic entitlement to statutory retrenchment compensation. However, eligible gratuity, earned salary, leave encashment and contractual dues may still be payable. Review the exit classification and employment agreement.

06 Is gratuity the same as severance pay? +

No. Gratuity is a separately regulated service-linked benefit. Retrenchment compensation addresses a particular category of employment termination. An eligible worker may receive both where the respective conditions are met.

07 Can fixed-term employees receive gratuity? +

Yes, qualifying fixed-term employees can receive gratuity under the applicable provisions. Government guidance addresses eligibility after one year of service under a qualifying fixed-term contract. The nature of the contract and service period must be verified.

08 How are additional months of service counted? +

For the calculator's retrenchment model, an additional service period exceeding six months increases the qualifying year count. The ordinary gratuity model separately applies the relevant service-rounding approach. Fixed-term gratuity uses a proportionate illustration where eligible.

09 Is notice pay included in severance? +

Notice pay can be a separate part of an employment exit settlement. It is not automatically due in every case. If the required notice has been served, adding a full notice-payment amount again could overstate the settlement.

10 Is severance pay calculated from CTC? +

Not automatically. The legally applicable wage or average-pay definition should be used. CTC may include employer contributions, insurance, incentives and other benefits that do not necessarily form part of the qualifying wage base.

11 Is the calculator result tax-free? +

No tax-free treatment is assumed. Tax exemptions and withholding rules vary by payment type and individual circumstances. The displayed result is before tax and should not be treated as a guaranteed net bank-credit amount.

12 Can an employer offer more than the statutory amount? +

Yes. A contract, settlement agreement or employer policy may provide more favourable benefits than an applicable statutory minimum. Any additional amount should be identified separately and supported by written terms.

Employment-law and financial information notice: This calculator provides educational estimates, not legal advice, payroll certification or a determination of statutory entitlement. Applicable provisions may depend on employment classification, establishment type, continuous service, wage definitions, termination circumstances, statutory exceptions, government notifications and contractual terms. Confirm important figures with the employer, relevant labour authority or qualified professional.

Calculation limitations: The model does not automatically calculate tax, EPF settlement, pension benefits, statutory compensation ceilings, dispute awards or all possible contractual benefits. Its gratuity and retrenchment calculations use simplified monthly-wage assumptions. A negative result after recoveries is treated as an invalid settlement scenario rather than an amount owed by the employee.
